RE: The tariff classification of a hat from China.

Dear Ms. Schaefer:

In your letter dated October 30, 2007, you requested a classification ruling on behalf of Cloudveil Mountain Works. The sample will be returned to you as requested.

The submitted sample, Style CV09367 is a baseball-style cap with four panels and the peak made of woven cotton fabric and a front panel with an overlay of woven bonded 34% polyester/66% nylon fabric. The five panel hat has a textile button on top, adjustable strap at the back and a peak. The cotton fabric imparts the essential character of the cap.

           The applicable subheading for Style CV09367 will be 6505.90.2060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether lined or trimmed: Other: Not knitted: headwear of cotton, Other.” The duty rate will be 7.5 percent ad valorem. The textile category designation is 359.
