RE: The tariff classification of an ultraviolet toothbrush sanitizer from China

Dear Mr. Ezekiel:

In your letter dated November 2, 2007, you requested a tariff classification ruling.

The item concerned is an ultraviolet toothbrush sanitizer. This item is comprised of a hard plastic container/toothbrush holder with an ultraviolet light built into its interior. This device is battery-operated.

The purpose of this item is to store and sanitize a toothbrush. In use, a toothbrush would be placed in the sanitizer with the bristles facing the ultraviolet light. When the door of the sanitizer is closed, the ultraviolet light illuminates and the sanitization process begins. The sanitizer turns off automatically after 8 minutes.

The applicable subheading for the ultraviolet toothbrush sanitizer will be 8543.70.9650, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electricalapparatus, having individual functions, not specified or included elsewhere: Otherapparatus: Other: Other: Other: Other”. The rate of duty will be 2.6%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
