RE: The tariff classification of a woman’s knit vest from China.

Dear Mr. Lau:

In your letter dated August 18, 2006, you requested a classification ruling. Your sample is being returned as requested.

The submitted sample, style 39131 is a woman’s sleeveless vest that is constructed from 80% cotton, and 20% polyester velour knit fabric. The vest features a stand-up rib knit collar, a full front opening with a zipper closure, kangaroo pockets at the waist, oversize armholes, and a rib knit bottom. The garment also has decorative beads and spangles on the front panel.

The applicable subheading for the vest, style 39131 will be 6110.20.2035, Harmonized Tariff Schedule of the United States (HTSUS), which provides for vests, knitted or crocheted, of cotton: other, other, vests, other than sweater vests, women’s. The duty rate will be 16.5% ad valorem.

The vest, style 39131 falls within textile category 359. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
