RE: The tariff classification of a girl’s sweater from China

Dear Ms. Whitley:

In your letter dated August 10, 2006 you requested a classification ruling.

Submitted style 400417 is a girl’s pullover style sweater. It is manufactured from jersey knit fabric that measures less than 9 stitches per 2 centimeters counted in the direction the fabric is formed. The fabric is 92% polyester, 8% metallic fibers. Two ply are 100% polyester yarn and one ply is polyester metallic yarn. The garment has long sleeves, a hood, a vee neck opening, scoop pockets and rib knit fabric at the hood, neck opening, sleeves and waistband.

As you have requested, the sample garment is being returned.

The applicable subheading for this style will be 6110.30.3025, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, knitted or crocheted, of man-made fibers, other, other, sweaters, girls’. The duty rate will be 32 per cent ad valorem.

The pullover falls within textile category designation 646. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
