RE: The tariff classification of motors from South Korea.

Dear Mr. Franks:

In your letter dated September 25, 2003, you requested a ruling on behalf of LG Electronics, Inc. on tariff classification.

The merchandise is a number of single-phase, split-capacitor motors used in air conditioners. The models are: the AMR-064L6 (1/8 Hp); the AMR-064B2 (1/10 Hp); the AMR-064L5 (1/12 Hp); the AMR-063L1L (1/4 Hp); and, the AMR-240B4L (1/3Hp). for a washing machine, item DMR-170L1. Section XVI, Chapter 85, Additional US Note 1 provides that 746 Watts equals 1 horsepower.

The applicable subheading for the AMR-064B2 and the AMR-064L5 will be 8501.40.2040, Harmonized Tariff Schedule of the United States (HTS), which provides for electric motors and generators, other AC motors, single-phase, of an output exceeding 37.56 W but not exceeding 74.6 W, other. The general rate of duty will be 3.3 percent ad valorem.

The applicable subheading for the other products will be 8501.40.4040, Harmonized Tariff Schedule of the United States (HTS), which provides for electric motors and generators, other AC motors, single-phase, of an output exceeding 74.6 W but not exceeding 735 W, other. The general rate of duty will be 4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.).
