RE: The tariff classification of a women’s knit pullover and top from Turkey

Dear Ms. Csekme:

In your letter dated August 15, 2001, you requested a tariff classification ruling.

Style # 38-0084k, consisting of a women’s pullover and top, was submitted. The garments which are attached at the shoulders, were submitted with the top inside the pullover. The garments are not permanently attached. The pullover and the top are separately classified. The pullover is composed of 100% nylon finely knit mesh fabric. Features of the pullover include a v-shaped, capped neckline; three quarter length, hemmed sleeves; sequin and beading ornamentation; and a hemmed bottom. The sleeveless top is composed of 94% polyester and 6% spandex finely knit fabric. The top features capping around the neckline and the upper edge of the garment which extends to form straps that cross the shoulders; a rear panel that extends straight across from side seam to side seam at the top; and a hemmed bottom. Per your request, your sample is returned herewith.

The applicable subheading for the pullover will be 6110.30.3055, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: other: women’s or girls’. The rate of duty will be 32.7 percent ad valorem.

The applicable subheading for the top will be 6114.30.1020, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted: of man-made fibers: Tops: Women’s or girls’. The rate of duty will be 28.9 percent ad valorem.

The pullover and the top fall within textile category designation 639. Based upon international textile trade agreements, products of Turkey are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
