RE: The tariff classification of air conditioner hose fittings and clamps from Italy.

Dear Mr. Steere:

In your letter dated May 1, 2000 you requested a tariff classification ruling.

You have stated that these electroplated steel hose fittings and clamps are not off the shelf items. They are custom made to your specifications for use with bus air conditioners. Drawings have been provided for a 90 degree fitting with high side access, a straight connection, a 90 degree fitting and a double clic clamp. The fittings are made with double sets of sealing surfaces and double o-rings to assure a complete seal when the double clic clamp is in place.

Citing HQ ruling 088393 of March 26, 1991, you believe that these items would not be classifiable under heading 7307, HTS, which provides for tube or pipe fittings of iron or steel.

The applicable subheading for the air conditioner hose fittings and clamps will be 8415.90.8085, Harmonized Tariff Schedule of the United States (HTS), which provides for parts of air conditioning machines. The rate of duty will be 1.4 percent.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
