RE: The tariff classification of men’s jacket and shirt from India

Dear Ms. Chan:

In your letter dated March 21, 2000, you requested a classification ruling.

Two garments were submitted and will be returned as you have requested. Style 43973 is described as a men’s woven quilted cotton shirt. The garment features long sleeves with one button placketed cuffs, a pointed shirt collar, a full frontal opening with seven small buttons, two breast pockets with button flaps and a lightly filled quilted lining. Style 43978 is described as a woven shirt jacket. The jacket is made of two fabrics laminated together; each fabric in the lamination is 60 percent wool and 40 percent viscose rayon fiber. The garment features a full frontal opening closed by means of six substantial snap buttons, two breast pockets with flaps, long sleeves with cuffs that are tightened by means of a snap button and side vents. The combined weight of the bonded fabrics is stated to be twenty ounces per yard.

The applicable subheading for style 43973 will be 6205.20.2065, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s or boys’ shirts, of cotton, other, other, other, other, men’s. The duty rate will be 20.2 percent ad valorem.

The applicable subheading for style 43978 will be 6201.91.2011, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s or boys’ overcoats, carcoatsanoraksand similar articles, other than those of heading 6203, anoraks, windbreakers and similar articles, of wool or fine animal hair, other, men’s. The duty rate will be 51cents/kg plus 20.2 percent ad valorem.

Style 43973 falls within textile category designation 340. Based upon international textile trade agreements products of India are subject to quota and the requirement of a visa.

Style 43978 falls within textile category designation 434. Based upon international textile trade agreements products of India require a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
