RE: The tariff classification of men’s knit garments from Australia, Indonesia, Mauritius, Sri Lanka and Thailand.

Dear Ms. Greener:

In your letter, dated December 29, 1999, you requested a tariff classification ruling. As requested, your samples will be returned.

Style 033-0514 (in men’s regular sizes) is a pullover garment constructed from 100 percent cotton, double knit fabric that measures 13 stitches per two centimeters counted in the horizontal direction. Style 033-0514 features a rib knit Henley neckline; a partial front opening with a two button closure; long sleeves with rib knit cuffs; and a straight, hemmed bottom with side slits and a tail. The same garment will be imported in men’s tall sizes as Style 033-0515.

Style 033-0489 (in men’s regular sizes) is a pullover garment constructed from 100 percent cotton, double knit fabric that measures 13 stitches per two centimeters counted in the horizontal direction. Style 033-0489 features a rib knit crew neckline; long, raglan sleeves with rib knit cuffs; self-fabric inserts on the side panels; and a straight, hemmed bottom. The same garment will be imported in men’s tall sizes as Style 033-0490.

Style 033-0518 (in men’s regular sizes) is a sweater vest constructed from 100 percent cotton, double knit fabric that measures 7 stitches per two centimeters counted in the horizontal direction. Style 033-0518 features oversized armholes; a V-neckline; and a straight, hemmed bottom with side slits. The neckline and the armholes are finished with self-fabric edging. The same garment will be imported in men’s tall sizes as Style 033-0519.

Style 004-0321 (in men’s regular sizes) is a vest constructed from 100 percent cotton, 2x2 rib knit fabric that measures 10 stitches per two centimeters counted in the horizontal direction. Style 004-0321 features oversized armholes; a V-neckline; a half-moon; 1x1 rib knit inserts at each side; an elastic hanger loop on the inside neckline; and a straight bottom. The neckline, the armholes and the bottom are finished with jersey knit capping. The same garment will be imported in men’s tall sizes as style 004-0322.

Style 004-0293 (in men’s regular sizes) is a pullover garment constructed from 100 percent cotton, 2x2 rib knit fabric that measures 10 stitches per two centimeters counted in the horizontal direction. Style 004-0293 features a rib knit crew neckline, long sleeves with an underarm grommet, and a straight bottom. The sleeves and the bottom are finished with jersey knit capping. The same garment will be imported in men’s tall sizes as Style 004-0294.

The applicable subheading for Styles 033-0514, 033-0515, 033-0489, 033-0490, 004-0293 and 004-0294 will be 6110.20.2065, Harmonized Tariff Schedule of the United States (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: men’s and boys’. The duty rate will be 18.2 percent ad valorem.

The applicable subheading for Styles 004-0321 and 004-0322 will be 6110.20.2030, Harmonized Tariff Schedule of the United States (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: vests, other than sweater vests: men’s and boys’. The duty rate will be 18.2 percent ad valorem.

The applicable subheading for Styles 033-0518 and 033-0519 will be 6110.20.2010, Harmonized Tariff Schedule of the United States (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: sweaters: men’s. The duty rate will be 18.2 percent ad valorem. Styles 033-0514, 033-0515, 033-0489, 033-0490, 004-0293 and 004-0294 fall within textile category designation 338. Styles 033-0518 and 033-0519 fall within textile category designation 345. Styles 004-0321 and 004-0322 fall within textile category designation 359. Based upon international textile trade agreements, products of Indonesia, Sri Lanka and Thailand are subject to visa requirements and quota restraints. Products of Mauritius that fall within textile category designation 338 and 345 are subject to visa requirements and quota restraints. Products of Mauritius that fall within textile category designation 359 are subject to visa requirements. Products of Australia are not presently subject to visa requirements or quota restraints.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
