RE: The tariff classification of open work knit fabric from Korea

Dear Mr. Hong:

In your letter dated October 18, 1999, you requested a classification ruling.

You submitted two samples of knit fabric which you identified as articles DI-15140 and DI-15122. You describe DI-15140 as a 95 percent polyester, 5 percent spandex mesh printed warp knit fabric, measuring 58 to 60 inches in width. Sample DI-15122 is described as a 100 percent nylon mesh printed warp knit fabric, also measuring 58 to 60 inches in width.

The applicable subheading for DI-15140 will be 6002.30.2020, Harmonized Tariff Schedule of the United States (HTS), which provides for other knitted or crocheted fabrics, of a width exceeding 30 cm., containing by weight 5 percent or more of elastomeric yarn or rubber thread, containing elastomeric yarn, open-work fabrics, warp knit. The duty rate will be 13.2 percent ad valorem.

The applicable subheading for DI-15122 will be 6002.43.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for other knitted or crocheted fabrics, other fabrics, warp knit, of man-made fibers, open-work fabrics. The duty rate will be 12 percent ad valorem.

DI-15140 falls within textile category 222. DI-15122 falls within textile category designation 229. Based upon international textile trade agreements products of Korea within textile category 222, are subject to quota and the requirement of a visa. Products of Korea within textile category 229 require a visa, but are not subject to quota.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
