RE: The tariff classification of kitchen towels and a dishcloth from India.

Dear Mr. Lancaster:

In your letter dated October 4, 1999 you requested a classification ruling.

You submitted samples of two towels and a dishcloth. Style nos. DT-001 and DT-002 are kitchen towels made from 100 percent cotton woven fabric. Both towels measure 18 x 27 inches and all of the edges are hemmed. They feature a hang loop on one corner. Style DT-001 is of waffle weave construction and it has vertical and horizontal stripes featuring a woven jacquard design of pine trees and pinecones. Style DT-002 contains different weaves including jacquard designs of rabbits and carrots. The dishcloth style DT-003 is made from 100 percent cotton woven fabric and it measures 13 x 14 inches. All of the edges are hemmed and it is of a waffle weave construction. As requested the samples are being returned.

The applicable subheading for the kitchen towels will be 6302.91.0035, Harmonized Tariff Schedule of the United States (HTS), which provides for bed linen, table linen, toilet linen and kitchen linen: other: of cotton other: towels: jacquard figured. The rate of duty will be 9.8 percent ad valorem.

The applicable subheading for the dish cloth will be 6307.10.2027, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles, including dress patterns: floorcloths, dishcloths, dusters and similar cleaning cloths: dish cloths: of cotton. The duty rate will be 7.9 percent ad valorem.

Styles DT-001 and DT-002 fall within textile category designation 363. Style DT-003 falls within textile category designation 369. Based upon international textile trade agreements products of India are subject to quota and the requirement of a visa. Style DT-003 is only subject to the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
