RE: The tariff classification of a women’s woven wearing apparel from Hong Kong and India

Dear Ms. Girvin:

In your letter dated September 7, 1999, you requested a classification ruling. The samples submitted with your request will be returned to you under separate cover.

Style 017-0684 is a woman’s dress constructed from 100 percent cotton woven fabric. The sleeveless dress features a drawstring hood, a partial front opening secured by one button, side seam pockets and side vents. This dress will also be imported in regular, petite and tall sizes under style numbers 011-0566 (reg), 017-0683 and 011-0565 (pet) and 017-0685 and 011-0567 (tall). The 017 prefix indicates retail sales and the 011 prefix indicates catalogue sales.

Style 017-0738 is a woman’s full body garment constructed from 100 percent linen woven fabric. The garment features a straight neckline, ½ inch wide shoulder straps which extend to the waist in back, two front pockets and wrap around styling with a front tie closure. The garment leaves the sides and back bare.

Style 017-0690 is a woman’s dress constructed from 100 percent cotton woven fabric. The is sleeveless and features a drawstring neckline, ½ inch wide shoulder straps and extends from the shoulders to mid-calf. This dress will also be imported in petite and tall sizes under style number 017-0689 and 017-0691.

The applicable subheading for styles 017-0684 and 017-0690 will be 6204.42.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): dresses: of cotton: other: other: with two or more colors in the warp and/or the filling: women’s. The duty rate will be 10.5 percent ad valorem.

The applicable subheading for style 017-0738 will be 6211.49.9090, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of other textile materials: other: other. The duty rate will be 7.6 percent ad valorem.

Styles 017-0684 and 017-0690 fall within textile category designation 336 and style 017-0738 falls within textile category designation 859. Based upon international textile trade agreements products of Hong Kong and India are subject to quota restraints and a visa requirement.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
