RE: The tariff classification of a drawstring bag, wooden scoop, and paper box from China/Korea.

Dear Ms. Clancy:

In your letter dated June 14, 1999, you requested a classification ruling for a drawstring bag, wooden scoop, and paper box from China/Korea.

The samples submitted with your request, no style numbers identified, are a drawstring bag, scoop, and empty box. You state in your request that these items will be imported separately and put together in the U.S. to be sold at retail as a set. The drawstring bag is constructed wholly of jute textile material and will be used to hold the scoop, box, and spices (the spices will be supplied in the U.S). The scoop is made of wood and will be used to take spices from the box. The empty box is constructed of paper and is foldable.

The applicable subheading for the jute bag will be 4202.92.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bags, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction. The duty rate will be 6.1% ad valorem.

Items classifiable under HTS subheading 4202.92.2000 fall within textile category designation 870. Based upon international textile trade agreements products of China and Korea are subject to quota and the requirement of a visa. The applicable subheading for the wooden scoop will be 4419.00.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for tableware and kitchenware, of wood, forks and spoons. The duty rate will be 5.3% ad valorem.

The applicable subheading for the empty paper box will be 4819.20.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for other folding cartons, boxes and cases of non-corrugated paper or paperboard. The duty rate will be 1.4% ad valorem.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
