RE: The tariff classification of a utensil box, a vase, and decorative buckets from South Africa

Dear Ms. Rodda:

In your letter dated August 15, 1997, you requested a tariff classification ruling.

The merchandise consists of a utensil box, a scalloped bucket, a large umbrella bucket, and a vase. You also requested the classification of a clock which we will address in a separate ruling letter.

The first item, the utensil box, is a rectangular aluminum container with a carrying handle. It measures 8 inches high by 8 inches wide, and is decorated with an aluminum sunflower. The utensil box will be used in the household to hold flatware.

The applicable subheading for the utensil box will be 7615.19.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for table, kitchen or other household articles and parts thereof, of aluminum, other, other. The duty rate will be 3.4 percent ad valorem.

Articles classifiable under subheading 7615.19.9000, HTS, which are products of South Africa are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

The next item is an aluminum vase. It is 6.5 inches in height and 2 inches in diameter, and is decorated with an aluminum sunflower.

The applicable subheading for the vase will be 8306.29.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for statuettes and other ornnaments, and parts thereof, of base metal, other. The duty rate will be 2 percent ad valorem.

Articles classifiable under subheading 8306.29.0000, HTS, which are products of South Africa are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

We are unable to classify the scalloped bucket and the large umbrella bucket without additional information. Please specify exactly what type of metal these two articles are composed of, i.e., steel, tinplate, aluminum, tin. What is the principal use of the large umbrella bucket? Is it just as likely to be used to store umbrellas as hold flowers? Is it designed to stand on the floor?

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
