RE: The tariff classification of letter/napkin holders and picture frames from South Africa

Dear Ms. Rodda:

In your letter dated August 15, 1997, you requested a tariff classification ruling.

The merchandise consists of a letter\napkin holder and four styles of picture frames made of aluminum. The letter\napkin holder is 2.5 inches high by 4.75 inches wide. It is decorated by a lizard, but is also available in other animal designs. The four styles of picture frames vary in design, and include rectangular as well as animal shapes. The frames range in size from 6.75 inches high by 6 inches wide to 12 inches high by 8.75 inches wide. The applicable subheading for the letter\napkin holder will be 7615.19.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for table, kitchen or other household articles and parts thereof, of aluminum, other, other. The rate of duty will be 3.4 percent ad valorem.

Articles classifiable under subheading 7615.19.9000, HTS, which are products of South Africa are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

The applicable subheading for the picture frames will be 8306.30.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for photograph, picture or similar frames, of base metal. The rate of duty will be 3.7 percent ad valorem.

Articles classifiable under subheading 8306.30.0000, HTS, which are products of South Africa are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
