RE: The tariff classification of panties from China.

Dear Mr. Fernandez:

In your letter dated July 31, 1997, you requested a classification ruling on behalf of Piege Co., Inc.

Two samples were submitted for review. Style 346P is a thong style bikini with an embroidered woven front panel constructed of 65% polyester 35% cotton and a back thong panel constructed of knitted 95% cotton 5% lycra spandex fabric. The panty features an elasticized waist and leg openings. Style 446P is a full cut bikini version of style 346P. The essential character of both styles is imparted by the embroidered woven fabric.

The applicable subheading for both styles will be 6208.92.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for Women's or girls' singlets and other undershirts, slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles: other: of man-made fibers . . . other: women's. The duty rate will be 16.7%.

Both styles fall within textile category designation 652. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
