RE: The tariff classification of stators and rotors for seal compressors

Dear Mr. Steere:

In your letter dated March 14, 1996 you requested a tariff classification ruling.

The items involved in this request consist of rotors and stators for use in hermetic and semi-hermetic sealed compressors. These compressors, in which the motor portion shares an integral housing with the rest of the compresor, are of the type normally found in home refrigeration units. As can be seen in the enclosed diagram, the shaft for the rotor also functions as the crank shaft for the compressor pistons. The stator can also be distinguished from those used on other electric motors in that it has passage through it for insertion of a crankcase pressure equalization spinner tube.

The applicable subheading for the stators and rotors for compressors will be 8414.90.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for stators and rotors as parts of compressors used in refrigeration equipment. The rate of duty will be 2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
