RE: The tariff classification of bath slings from China

Dear Mr. Miles:

In your letter dated April 25, 2008, you requested a tariff classification ruling on behalf of your client, Summer Infant, Inc., of Woonsocket, Rhode Island.

The items in question are bath slings (item Numbers 08290-03 and 08640-03). You indicate that a baby is placed on them for bathing. One end is elevated to keep the baby’s head out of the water. You state that they are constructed of textile fabric stretched over a steel frame. Item 08640-03 is slightly more elaborate and features a cushion on the “elevated” end. After importation, both slings are repackaged with U.S.-made plastic baby bath tubs and shower units made of imported and domestic components.

The applicable subheading for the bath slings will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
