RE: The tariff classification of a label holder from China

Dear Ms. Hiltpold:

In your letter received on April 30, 2008, you requested a tariff classification ruling. The sample which you submitted is being retained by this office.

The merchandise under consideration is described as a Label Holder, part number LH04. It is made of steel and comes with a paper label and a vinyl protective shield. The label holder snaps onto the drawer divider or partition of a tool cabinet to provide instant identification of the contents. It measures 2-5/8 inches in length.

The applicable subheading for the label holder will be 8302.42.3065, Harmonized Tariff Schedule of the United States (HTSUS), which provides for base metal mountings, fittings and similar articlesother mountings, fittings and similar articles, and parts thereof, other, suitable for furniture, of iron or steel, of aluminum or of zinc, other. The rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
