RE: The tariff classification of a woman’s sweater from China.

Dear Ms. Wong:

In your letter dated April 14, 2008 you requested a classification ruling. As requested, your sample is being returned to you.

The submitted sample, style PP 1070151, is a woman’s sweater that is constructed from 55% ramie and 45% acrylic knit fabric. The outer surface of the garment measures nine or fewer stitches per two centimeters in the direction the stitches were formed. The garment extends from the shoulders to below the waist. The garment features a rolled collar with a v-shaped neckline, a full front opening with a self-fabric tie closure at the waist, long sleeves, and a straight garment bottom.

The applicable subheading for the sweater will be 6110.90.9042, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted (con): Of other textile materials (con): other: sweaters for women’s or girl’s: other: other: other. The duty rate will be 6% ad valorem.

The sweater falls within textile category 845. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
