RE: The tariff classification of girls garments from China.

Dear Mr. Lee:

In your letter dated April 14, 2008, on behalf of Impulse Fashion, Inc. dba Prey, you requested a tariff classification ruling. As requested, the samples will be returned to you.

You have submitted two samples. Style 34E2434A is a girl’s dress constructed of 95% cotton, 5% spandex knit fabric. The dress has a scoop neck with additional fabric insert, long sleeves, a dropped waist, a decorative buckle on the bodice, a back tie at the waist and a hemmed bottom.

Style 34E2434B is a girl’s pant constructed of 95% cotton, 5% spandex knit fabric. The pant has an enclosed elasticized waist and hemmed bottoms.

The applicable subheading for the style 34E2434A dress will be 6104.42.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts, knitted or crocheted: dresses: of cotton: girls’. The rate of duty will be 11.5 percent ad valorem.

The applicable subheading for style 34E2434B pants will be 6104.62.2026, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts, knitted or crocheted: trousers, bib and brace overalls: of cotton: other, other: trousers and breeches: girls’: other: containing 5 percent or more by weight of elastomeric yarn or rubber thread. The duty rate will be 14.9 percent ad valorem.

Style 34E2434A (dress) falls within textile category 336. Style 34E2434B (pants) falls within textile category 348. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
