RE: The tariff classification of three magnetic bulletin boards from China

Dear Mr. Hollis:

In your letter dated March 13, 3008 you requested a tariff classification ruling.

The merchandise subject to this ruling is three magnetic bulletin boards. They are identified within your letter as SKU# 10047355, SKU# 10040617, and SKU# 10047353. Each of the three different styles is made of galvanized steel and uses small magnet dots to secure photos, lists, and other items of interest.

The magnetic bulletin board identified as SKU# 10047355 is marketed as the 16” Big Dot Bulletin Board. It is white in color and measures 16” round in diameter. It is made of galvanized steel with a white powder-coating. It includes small dot neodymium magnets and mounting hardware (screws).

The magnetic bulletin board identified as SKU# 10040617 is marketed as the 12” Square Dot Bulletin Board. It is walnut in color and measures 12” square. It is made of galvanized steel with a thin maple veneer (real maple). It includes small dot neodymium magnets and mounting hardware (screws).

The magnetic bulletin board identified as SKU# 10047353 is marketed as the 12” Square Dot Bulletin Board in Bamboo. It measures 12” square. It is made of galvanized steel with a thin bamboo veneer (real bamboo). It includes small dot neodymium magnets and mounting hardware (screws).

The applicable subheading for the three magnetic bulletin boards (SKU# 10047355, SKU# 10040617, and SKU# 10047353) will be 8505.11.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Permanent magnets: Of metal.” The rate of duty will be 2.1 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
