RE: The tariff classification of a rug from China

Dear Mr. Thompson:

In your letter dated March 5, 2008 you requested a classification ruling on behalf of G.A. Gertmenian & Sons.

The submitted sample, described as Design #G11556 “Snow Much Fun” #S11780, is a rug. The face of the rug is made from nylon yarns. The yarns have been tufted into a pre-existing base. It features a plastic foam anti-slip backing. The face of the rug is printed with a snowflake pattern and the semi-circular rug measures approximately 31 x 55.5 inches.

The applicable subheading for the rug will be 5703.20.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for carpets and other textile floor coverings, tufted, whether or not made up: of nylon or other polyamides: other measuring not more than 5.25 m2 in area. The rate of duty will be 6.7 percent ad valorem.

The rug falls within textile category 665. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
