RE: The tariff classification of motor vehicle parts from Japan

Dear Ms. Guillen,

In your letter dated March 7, 2008, you requested a tariff classification ruling.

The items under consideration are several pieces of metal netting used as cosmetic appliqués, as well as functioning as a barrier to prevent debris or other small objects from entering into the bumper area and damaging other parts inside the bumper area. In your Ruling Request you have identified these parts as numbers MN126774, MN126771, MN154997, MN154998, MN126773 and MN126517.

Part number MN126774 covers the passenger side bottom portion of the bumper fascia to protect the T/M Oil Cooler Duct.

Part number MN126771 covers the bottom center portion of the bumper fascia and protects the Turbo Inter-cooler.

Part numbers MN154997 and MN154998 cover the middle section of the bumper fascia and protect the Turbo Inter-cooler portion which is in front of the radiator.

Part number MN126773 covers the driver side bottom portion of the bumper fascia and protects the front Bumper Air Intake Cover.

Part number MN126517 covers the top portion of the bumper fascia and protect the radiator.

The applicable classification subheading for the metal netting (Part #’s MN126774, MN126771, MN154997, MN154998, MN126773 and MN126517) will be 8708.29.5060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Partsofmotor vehicles : Other partsof bodies: Other: Other: Other”. The rate of duty will be 2.5%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
