RE: The tariff classification of vases from China

Dear Ms. Nemitz:

In your letter dated March 7, 2008, you requested a tariff classification ruling.

The merchandise under consideration is two styles of decorative, hand-painted vases made of base metal. According to your letter, they are strictly Decorative and are not intended for food use. Each article contains a label that warns it is unsafe for food use and may poison food.

Item number A2000042 is described as a “Hadara Wall Sconce.” It is a decorative, wall-mounted container that is designed to hold ornamental articles, such as dried or silk flowers. It measures 8 inches by 4.5 inches by 9.25 inches.

Item number A2000041 is described as a “Hadara Vase”. It is a decorative pot designed to rest on a table-top and hold ornamental articles, such as dried or silk flowers. It measures 13.5 inches by 7.5 inches by 8.5 inches.

The applicable subheading for the sconce and vase will be 8306.29.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for statuettes and other ornaments, and parts thereof, of base metal. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
