RE: The tariff classification of a woman’s jacket from China & Vietnam

Dear Mr. LoPresti:

In your letter dated February 20, 2008, you requested a classification ruling on behalf of Elie Tahari Ltd. Your sample will be returned.

Submitted sample, style #E8060198, is a woman’s suit-type jacket constructed from 100% silk woven fabric. The suit-type jacket extends from the shoulder to slightly below the waist. The collarless suit-type jacket features a round neckline, long sleeves with vents, a full front opening secured by six snap closures and two patch pockets below the waist.

The applicable subheading for the style E8060198 will be 6204.39.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): suit-type jackets and blazers: of other textile materials: other: containing 70 percent or more by weight of silk or silk waste. The duty rate will be 1 percent ad valorem.

Style E8060198 falls within textile category 735.
