RE: The tariff classification of Granisetron (CAS-109889-09-0) imported in dosage/tablet form, from India

Dear Mr. Moynihan:

In your letter dated February 26, 2008, you requested a tariff classification ruling.

The subject product, Granisetron is a medicinal preparation containing Granisetron, an antinauseant and antiemetic agent, as the active ingredient. It is indicated for the prevention of nausea and vomiting associated with both emetogenic cancer chemotherapy and radiation therapy.

The applicable subheading for the Granisetron in dosage/tablet form will be 3004.90.9160, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Medicaments consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses or in forms or packings for retail sale: Other: Other: Other: Medicaments primarily affecting the digestive system: Other." The rate of duty will be free.
