RE: The tariff classification of a rug from Hong Kong

Dear Ms. Choo:

In your letter dated February 19, 2008 you requested a classification ruling on behalf of ITOCHU Prominent USA LLC.

The submitted sample is a rug. The rug is made from 3 layers that are laminated together. The top or face layer is made from 100 percent polyester knit pile fabric. The middle layer is made from 5mm urethane foam. The bottom layer is made from polyester felt. The rug has rounded corners and the edges are bound with a strip of woven fabric. The rug measures approximately 72 x 74 inches.

The applicable subheading for the rug will be 5705.00.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other carpets and other textile floor coverings, whether or not made up: other of man-made fibers. The duty rate will be 3.3 percent ad valorem.

The rug falls within textile category 665. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
