RE: The tariff classification of a decorative glass article from China

Dear Mr. Crago:

In your letter dated February 22, 2008, you requested a tariff classification ruling. A photograph was submitted with your ruling request.

The subject merchandise, designated as item number A072SA00021, is a set that consists of a glass mirrored tray with a mosaic border, three mosaic glass vessels, gold-colored glass beads and three unscented tealight candles. The glass tray measures approximately 13-3/8” in length by 5-3/4” in width by 1.2” in height. Each glass vessel measures 3-1/4” in height and 2-3/4” in diameter.

According to the information that was submitted with your ruling, the glass tray, glass vessels, beads and candles will be packed together for retail sale in their imported condition.

      The glass tray represents the essential character of this set. You indicated in your letter that the unit value of the glass tray will be over thirty cents but not over three dollars.

The applicable subheading for the set - item number A072SA00021 - will be 7013.99.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes: other glassware: other: other: valued over $0.30 but not over $3.00. The rate of duty will be 30 percent ad valorem.

The candles in question may be subject to antidumping duties or countervailing duties.
