RE: The tariff classification of Nabumetone (CAS-42924-53-8) imported in dosage/tablet form, from India

Dear Mr. Moynihan:

In your letter dated February 22, 2008, you requested a tariff classification ruling.

The subject product, Nabumetone in dosage/tablet form, is a medicinal preparation containing Nabumetone, a nonsteroidal anti-inflammatory drug (NSAID) that exhibits anti-inflammatory, analgesic and antipyretic properties, as the active ingredient. It is indicated for the treatment of osteoarthritis and rheumatoid arthritis.

The applicable subheading for the Nabumetone in dosage/tablet form will be 3004.90.9128, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Medicaments consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses or in forms or packings for retail sale: Other: Other: Other: Medicaments primarily affecting the central nervous system: Analgesics, antipyretics and nonhormonal anti-inflammatory agents: Other." The rate of duty will be free.
