RE: The tariff classification of a pullover from China.

Dear Ms. Helm:

In your letter dated February 13, 2008 you requested a classification ruling. As requested, your sample is being returned to you.

Style number G5087 is a woman’s “Gear For Sports” brand pullover that is constructed from 80% cotton and 20% polyester brushed knit fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction that the stitches were formed. The garment features a funnel collar, a partial front opening with a zippered closure that extends to the top of the collar, long sleeves with self-fabric cuffs, and a kangaroo pocket at the waist with zippered closures on either side. The garment extends below the waist and has a straight hemmed bottom. The “GEAR For Sports” logo is embroidered on the upper back panel.

The applicable subheading for style G5087 will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: Other: other: other: women’s or girls’: other. The duty rate will be 16.5%.

The pullover falls within textile category 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
