RE: The tariff classification of a men’s knit pullover garment from India.

Dear Ms. Helm:

In your letter dated February 12, 2008, you requested a tariff classification ruling. As requested, your sample will be returned.

Style CT1411 is a pullover garment constructed from 100% cotton, jersey knit fabric that measures 32 stitches per two centimeters counted in the horizontal direction. Style CT1411 is cut and sewn and has a rib knit crew neckline; a triangular overlay at the center front neckline; short, hemmed, raglan sleeves with distressed edges; screen printing on the sleeves; a heat seal logo on the right sleeve; a patch on the lower right side; and a straight, hemmed bottom with a distressed edge.

Although you refer to the garment as a unisex pullover, Style CT1411 is made to men’s specifications. Consequently, the applicable subheading for Style CT1411 will be 6110.20.2069, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: other: men's or boys'. The duty rate is 16.5% ad valorem.

Style CT1411 falls within textile category designation 338. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
