RE: The tariff classification of a shower caddy from China

Dear Ms. Ramsey:

In your letter dated January 14, 2008, you requested a tariff classification ruling. The sample which you submitted is being retained by this office.

The merchandise under consideration is described as a Chrome Suction Corner Shower Caddy, item number 64430. It is a caddy made of chrome-plated iron wire that includes four ā€œSā€ hooks, four plastic suction cups, two screws and two plastic wall anchors for hanging. It measures approximately 7-7/8 inches long by 7-7/8 inches wide by 5-3/8 inches high. The marketing literature you submitted indicates that the caddy can be used on a corner ledge of the bathtub to hold super-sized shampoo or conditioner bottles. Two knob-hooks situated at its top can be used for hanging shower puffs or loofah sponges.

The applicable subheading for the iron bathroom caddy will be 7324.90.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sanitary ware and parts thereof, of iron or steel, other, including parts. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
