RE: The tariff classification of styles 130192 & 130192(H), 130194 & 130194(H) and 130195 & 130195(H),  Child, Adult and Plus Size Musketeer Male Costumes from China, Taiwan, India, and Vietnam

Dear Ms. Tsiavos:

In your letter dated January 2, 2008, you requested a tariff classification ruling on the following flimsy costumes which are being returned upon your request.

Styles 130192 & 130192(H), 130194 & 130194(H) and 130195 & 130195(H),  Child, Adult and Plus Size Musketeer Male Costumes, are assorted styles of a flimsy textile costume that are constructed the same and consist of a top, tie collar, pants, a hat and boot covers, with the top imparting the essential character. Although the top has two styling features, a well-made styling feature edge and two well-made embellishments, it has a loose visible overlock stitched neck and seams, flimsy thin elastics at the arms, a flimsy hook and lab tab closure and raw or loose overlock stitched edges at the arms, bottom, closure and sleeve.

The applicable subheading for styles 130192 & 130192(H), 130194 & 130194(H) and 130195 & 130195(H),  Child, Adult and Plus Size Musketeer Male Costumes, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
