RE: The tariff classification of a woman’s shirt from India

Dear Ms. Doreen Rizzo:

In your letter dated December 5, 2007, you requested a classification ruling. Your sample will be returned as requested.

Submitted sample, style #4W501309, is a woman’s shirt constructed from 100% cotton woven fabric. The waistband and cuffs are constructed from 100% cotton knit fabric. The shirt features a collar, long sleeves with knit cuffs, a full front opening secured by seven buttons, two chest patch pockets with buttoned flaps and a rib knit waistband.

The applicable subheading for the style 4W501309 will be 6211.42.0054, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments, excluded from heading 6206: with two or more colors in the warp and/ or filling. The duty rate will be 8.1 percent ad valorem.

Style 4W501309 falls within textile category 341.
