RE: The tariff classification of a men’s double jacket set from China

Dear Ms. Timsit:

In your letter dated December 4, 2007, you requested a classification ruling. The sample you submitted is being returned as you requested.

The item in question, “3 in 1 jacket,” consists of a woven shell with a mesh lining and an inner jacket made of a knit fleece fabric which is joined to the outer jacket with zipper halves that also function as its closure when it is worn separately.

The outer jacket is made from a woven nylon fabric with a visible coating on the inner surface. It has a full front opening with a zipper closure that extends to the top of the collar, a rollup hood, tabs with a hook-and-loop closure at the sleeve ends, a tunneled elastic drawstring at the bottom hem, zippered pockets at the waist and in the right chest area and a mesh lining with a left chest pocket. The jacket has embroidery with various logos and the name “Kawasaki” prominently displayed.

The inner jacket is made from a 100% polyester double face pile fabric. It has a full front opening with a zipper closure that extends to the top of the collar, slant, zippered pockets at the waist, a tunneled drawstring at the bottom hem and elasticized sleeve ends.

The applicable subheading for the outer jacket will be 6210.40.5020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other men’s or boys’ anoraks (including ski-jackets), windbreakers and similar articles, made up of fabrics of heading 5602, 5603, 5903, 5906 or 5907, of man-made fibers. The duty rate will be 7.1 percent ad valorem. The applicable subheading for the inner jacket will be 6101.30.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Men's or boys' overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers and similar articles, knitted or crocheted, other than those of heading 6103, of man-made fibers. The duty rate will be 28.2 percent ad valorem.

These jackets each fall within textile category 634. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
