RE: The tariff classification of a plastic measuring cup from China.

Dear Ms. Meyer:

In your letter dated November 7, 2007, you requested a tariff classification ruling.

The submitted illustration depicts plastic measuring cups that are made of polypropylene (PP). On one side of each cup, the following words are printed: “Feeding guides are intended as a starting point. Adjust as needed to maintain proper weight.” On the opposing side of each cup, the following is printed: “www.HillsPet.com.” Also printed on that side of the cup are the words “Hill’s Pet Nutrition, Inc.”

Each cup is delineated with the following printed measurements: 1/8 cup, ¼ cup, 1/3 cup, 3/8 cup, ½ cup, 5/8 cup, 2/3 cup, ¾ cup, 1 cup. Although this item can be used by both consumers and veterinary clinics as an instrument to measure pet food, it is of the class or kind of merchandise that is principally used in the kitchen as a measuring cup.

The applicable subheading for the plastic measuring cup will be 3924.10.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides tableware, kitchenwareof plastics: tableware and kitchenware: other. The duty rate will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
