RE: The tariff classification of crochet needles, knitting needles, and assembled fabrics

Dear Ms. Hunt:

In your letter dated Oct. 11, 2007, you requested a tariff classification ruling. The samples which you submitted are being returned as requested. No country of origin was stated.

Item A is “Interchangeable Head Crochet.” It is a set with an aluminum crochet hook handle and 14 steel hooks of various sizes. The hooks are not for use in a machine. They are packed in a fitted carry case. The handle, hooks, and case form a set for tariff purposes, as per the terms of General Rule of Interpretation 3, Harmonized Tariff Schedule of the United States (HTSUS), with the essential character imparted by the hooks.

The applicable subheading for the crochet hooks and handle will be 7319.90.9000, HTSUS, which provides for Sewing needles, knitting needles, bodkins, crochet hooks, embroidery stilettos and similar articles for use in the hand, of iron or steel; safety pins and other pins of iron or steel, not elsewhere specified or included: Other: Other. The rate of duty will be 2.9% ad valorem.

Item B is “Bamboo circular knitting needles.” It is made of two bamboo knitting needles, approximately 5½” long, with a length of plastic tubing attaching them at the tops. The needles are used to knit sleeves and other round items.

The applicable subheading for the bamboo knitting needles will be 4417.00.8090, HTSUS, which provides for Tools, tool bodies, tool handles, broom or brush bodies and handles, of wood; boot or shoe lasts and trees, of wood: Other: Other. The rate of duty will be 5.1% ad valorem.

Item C is “Balloon tape.” It is a 100% cotton woven narrow fabric, approximately 1” wide, with small plastic rings (approximately 1/2" in diameter) sewn on every 5”. It is used in the assembly of window shades and is imported on large plastic spools to be cut to length at retail sales outlets.

Item D is “Snap tape.” It is a 100% cotton woven narrow fabric, approximately 3/4” wide, with metal grommets every 2”. It can be used for sewing children’s clothing or other items. It will be imported on large spools to be cut to length at retail sales outlets and also packaged in 6-yard packages.

Item E is “Double cord shirring tape.” It is a 100% polyester woven narrow fabric, approximately 1” wide, assembled with two inserted cords. It will be imported in various widths up to 4”, with up to 4 cords. It is used in the construction of window treatments and is imported on large plastic spools to be cut to length at retail sales outlets.

Items C, D, and E are considered “made up” for tariff purposes. The applicable subheading for the fabrics will be 6307.90.9889, HTSUS, which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem.
