RE: The tariff classification of a tote bag and laundry bag from China

Dear Ms. Antunes:

In your letter dated October 16, 2007, on behalf of Marketing Innovations, you requested a classification ruling. The samples which you submitted are being retained by this office.

The sample submitted is identified as style FS-06C07/1H. It is a double handle tote bag constructed with an outer surface of cotton textile material. The tote bag is designed to provide storage, organization, protection, and portability for clothing and other personal effects during travel. It has a textile lined storage compartment with a zippered pocket on one side and an open pocket on the other. The bag also has an open top which is secured with both a magnet and a metal carabineer. It measures approximately 20” (W) x 13.5” (H) x 7.25” (D).

The sample submitted is identified as style ST-05C012/CH. It is a laundry bag constructed of a 100 percent cotton woven fabric. The top opening of the bag features a drawstring closure. The front exterior of the bag is embellished with embroidery of shirts, shorts, socks , a laundry line and the words “wash me” and “beauticontrol”. It measures approximately 17” (W) x 22” (L).

The applicable subheading for the tote bag will be 4202.92.1500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports and similar bags, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, of cotton. The duty rate will be 6.3 percent ad valorem.

The applicable subheading for the laundry bag will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem.

HTSUS 4202.92.1500 falls within textile category 369. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
