RE: The tariff classification of shopping bags from China

Dear Ms. Julia:

In your letter dated October 11, 2007, you requested a tariff classification ruling. The samples which you submitted are being returned as requested.

Style numbers were not provided for the three samples submitted. The items are shopping bags of various sizes. Each bag is constructed with an outer surface of polyvinyl chloride (PVC) plastic sheeting material. All the bags have open tops, double handles, and unlined main compartments. They are each made up of a sheeting of plastics that measures 19 mils (a mil is one thousandth of an inch) thick. The shopping bags are substantially constructed and intended for repeated reuse. The principle use of the bags is to provide storage, protection, organization and portability to personal effects during travel.

The applicable subheading for the shopping bags will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports, and similar bags: with outer surface of plastic sheeting. The rate of duty will be 20 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
