RE: The tariff classification of men’s knit garments from China.

Dear Mr. Bartlett:

In your letter dated October 10, 2007, you requested a tariff classification ruling on behalf of Quality Worldwide, Inc. As requested, your samples will be returned.

Product K12013 “Culver Lite Hoodie” is a men‘s garment constructed from 85% polyester, 15% cotton, light weight jersey knit fabric that measures 26 stitches per 2 centimeters counted in the horizontal direction. The garment is cut and sewn and features a self-fabric hood with a drawstring; a full front opening with a zippered closure; long sleeves with rib knit cuffs; an embroidered logo on the left chest; pouch pockets below the waist; and a rib knit bottom.

Product K12014 “Dez Lite Hoodie” is a men’s pullover garment constructed from 65% cotton, 35% polyester, light weight jersey knit fabric that measures 32 stitches per 2 centimeters counted in the horizontal direction. The garment is cut and sewn and features a self-fabric hood with a drawstring; short sleeves with unfinished ends; a pouch pocket below the waist; and a rib knit bottom.

Product K12016 “Too Live Lite” is a men’s garment constructed from 65% cotton, 35% polyester, light weight jersey knit fabric that measures 32 stitches per 2 centimeters counted in the horizontal direction. The garment is cut and sewn and features a self-fabric hood with a drawstring; a full front opening with a zippered closure; long sleeves with rib knit cuffs; pouch pockets below the waist; and a rib knit bottom.

The applicable subheading for Product K12013 will be 6110.30.3053, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: men’s or boys’: other. The rate of duty is 32% ad valorem.

The applicable subheading for Products K12014 and K12016 will be 6110.20.2069, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: other: men's or boys'. The rate of duty is 16.5% ad valorem.

Product K12013 falls within textile category designation 638. Products K12014 and K12016 fall within textile category designation 338. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
