RE: The tariff classification of a 100% polyester unbleached weft knit fabric of double knit construction from Turkey.

Dear Mr. Ponthieux:

In your letter dated September 06, 2007, you requested a classification ruling.

The submitted sample, designated as style DJ100-1572.0, is an unbleached weft knit fabric of double knit construction that is composed of 100% polyester. It is characterized by a jacquard knit design featuring a stylized floral motif. During the knitting process polyester filament yarns have been inserted between the layers of knit stitches to increase the fabric’s bulk and provide this product with a spongy consistency. Weighing approximately 181 g/m2, this fabric will be imported in 229 centimeter widths. Your correspondence indicates that this item will be used as mattress ticking.

The applicable subheading for the double knit fabric designated as style DJ100-1572.0, will be 6006.31.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other knitted or crocheted fabrics, of synthetic fibers, unbleached or bleached, of double knit or interlock construction, of polyester. The duty rate will be 10 percent ad valorem.

This fabric falls within textile category 222. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
