RE: The tariff classification of CD and DVD storage cases from China

Dear Ms. Ramsey:

In your letter dated Sept. 4, 2007, you requested a tariff classification ruling.

You submitted two samples of CD and DVD storage cases. Each is constructed of 100% polypropylene spunbonded nonwoven fabric over a cardboard frame with a fabric handle. The cases are not specially fitted on the inside to hold the CD’s or DVD’s. The top folds over but does not close securely. The cases are designed and intended for domestic use; in fact, the label reads, “Home Storage / Organization.”

The first case, identified as SC-115 (item #62620), measures approximately 15” x 8” x 6” and holds 24 DVD’s. The second, SC-103 (item #62630), measures approximately 11” x 6” x 6½” and holds 25 CD’s.

The applicable subheading for the CD and DVD storage cases will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
