RE: The tariff classification of a men’s knit muscle shirt from Bangladesh.

Dear Ms. Breit:

In your letter dated August 3, 2007, you requested a tariff classification ruling on behalf of Roochi Traders, Inc. As requested, your sample will be returned.

Style M19501190 is a men’s muscle shirt constructed from 100% cotton, finely knit jersey fabric that measures 26 stitches per two centimeters counted in the horizontal direction. Style M19501190 is sleeveless and has a rib knit crew neckline, hemmed armholes, and a straight hemmed bottom.

The applicable subheading for Style M19501190 will be 6110.20.2069, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: other: men's or boys'. The duty rate is 16.5% ad valorem.

Style M19501190 falls within textile category designation 338.
