RE: The tariff classification of a costume from China.

Dear Mr. Fragomeli:

In your letter dated August 1, 2007, you requested a classification ruling. The samples which you submitted are being returned as requested.

The submitted sample, Honeydew Splash Costume will be imported as:

Item 6808081, Size S (4-6)
Item 6808082, Size M (8-10)
Item 6808083, Size L (12-14)

The Honeydew Splash Costume consists of a dress, pants, which you call leggings, and headband. The dress, pants and headband are made of knit 100% polyester fabric. The dress has piping trim on the neck, waist and hem and has a mesh skirt. The pants have an elasticized tunneled waistband and the headband measures approximately 3” in width.

The Honeydew Splash Costume is well made with styling and finished neck, waist, seams and hem.

The Honeydew Splash Costume consists of two or more garments. Note 14 of Section XI, of the HTSUS, requires that textile garments of different headings be separately classified, thus preventing classification of costumes consisting of two or more garments as sets. If a set cannot exist by application of Note 14, the articles that may be packaged with the garments must also be classified separately.

The applicable subheading for the dress, Items 6808081, 6808082 and 6808083 will be 6104.43.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear); knitted or crocheted: Dresses: Of synthetic fibers, Other, Women’s." The rate of duty will be 16% ad valorem. The textile category designation is 642.     

 The applicable subheading for the pants, Items 6808081, 6808082 and 6808083 will be 6104.63.2011, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts. Divided skirts, trousers, bib and brace overalls, breeches and shorts: Trousers, bib and brace overalls, breeches and shorts: Of synthetic fibers: Other: Other, Trousers and breeches: Women’s: Other." The duty rate will be 28.2% ad valorem. The textile category designation is 648.

The applicable subheading for the headband , Items 6808081, 6808082 and 6808083 will be 6117.80.8500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other made up accessories, knitted or crocheted; knitted or crocheted parts of garments or of clothing accessories: other accessories: Other: headbands, ponytail holders and similar articles." The duty rate will be 14.6% ad valorem.
