RE: The tariff classification of a textile trimming material, for use in the manufacture of garments, from Uruguay.

Dear Ms Fink:

In your letter dated August 1, 2007, you requested a tariff classification ruling.

The instant sample consists of a narrow width material (about 1/2") which is composed of a woven textile lip or fabric that has been sewn to a tubular piping which contains textile filaments running through its core. You write that this material is composed of 100% polyester man-made fibers. This material has application in the manufacture of apparel products for retail sale.

The applicable subheading for the product, which we presume will be imported in the piece, will be 5808.90.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for ornamental trimmings in the piece, of cotton or of man-made fibers. The rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
