RE: The tariff classification of a woman’s suit from China

Dear Ms. Purcell:

In your letter dated July 12, 2007, you requested a classification ruling. Your sample will be returned as requested.

Submitted sample, style #A18422, is a woman’s suit consisting of a jacket and pants. The jacket and pants are constructed from 62% polyester, 32% rayon and 6% spandex woven fabric. The fully lined jacket features a stand-up collar, long sleeves with button trim, two chest pockets with a button closure, two pockets below the waist with a button closure, a full front opening secured by five buttons and a self-fabric tie belt. The pants feature a waistband, front zipper, a one button closure, two side pockets and long hemmed legs.

The applicable subheading for the style A18422 will be 6204.13.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): suits: of synthetic fibers: other: women’s. The duty rate will be 35.3 cents per kilogram plus 25.9 percent ad valorem.

Style A18422 falls within textile category 644. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
