RE: The tariff classification of gloves from China

Dear Ms. McCabe:

In your letter dated June 12, 2007 you requested a classification ruling. The submitted sample will be returned.

The submitted sample, style TG8595, is a gunn-cut style glove with a complete palmside and backside constructed of a 100% cotton canvas fabric shell. With the exception of the middle and ring finger, the palmside is also quilted and lined. The glove features diamond designs on the backside and fourchettes, a hemmed bottom band, fourchettes, an open cuff and a partially elasticized wrist. You state that the glove will be primarily used for gardening.

The applicable subheading for the glove will be 6216.00.4100, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Gloves, mittens and mitts: other: of cotton: other: with fourchettes. The duty rate will be 23.5 percent ad valorem.

Style TG8595 falls within textile category 331. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
