RE: The tariff classification of a head covering from China.

Dear Ms. Collins:

In your letter dated June 12, 2007, you requested a classification ruling. The sample will be returned to you.

The submitted sample StyleYTRUS054 is a ladies head covering made of knit 80%cotton, 20% polyester velour fabric. The head coving is approximately 9” wide with a thick fabric covered elastic band at the back. The item is specifically designed to cover the crown of the head and would not be worn around the neck.

The applicable subheading for Style YTRUS054 will be 6505.90.1540, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not trimmedOther: Of cotton, flax or both: knitted, Of cotton: Other: Other." The duty rate will be 7.9% ad valorem. The textile category designation is 359.
