RE: The tariff classification of a woman’s blouse from China

Dear Ms. Fox:

In your letter dated June 15, 2007, you requested a classification ruling on behalf of Ann Taylor, Inc. Your sample will be returned as requested.

Submitted sample, style #24-208886, is a woman’s blouse constructed from both woven and knit fabric. The woven fabric is composed of 100% silk and the knit fabric is composed of 100% nylon. The garment has a woven underlay and insert with a lace knit overlay to simulate a layered-look. The sleeveless pullover garment is collarless and the woven inner portion features a scooped neckline and spaghetti shoulder straps. The knit outer portion features a v-neckline and approximately two and half inch wide shoulder straps, a side zipper, an empire waist, a full lining and a hemmed bottom. The garment will be imported in petite sizes under style #63-212309.

The applicable subheading for the style 24-208886 will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of man-made fibers: other: other: other: women’s. The duty rate will be 26.9 percent ad valorem.

Style 24-208886 falls within textile category 641.
